Official Rules & Eligibility

PURCHASE NECESSARY TO ENTER OR CLAIM A PRIZE.

1. HERE'S HOW TO ENTER: Visit Beau Cheval in Wartrace and register in person or visit www.BeauChevalWartrace.com and follow the on-screen instructions to enter the contests. You will be required to provide your name and email address and/or phone number for entry. Incorrect and incomplete entries are void. Entries for the contests will be accepted from 12:00 a.m. CDT October 2, 2020 through 11:59 p.m. CST on December 7, 2020 (“Entry Period”). No other attempted method of entry will be accepted; entries may not be mailed.

To enter the Beau Cheval in Wartrace Golden Pumpkins Contests Beauty & the Bash, entrants must fill out the online entry form. Entrants must provide the following information including, but not necessarily limited to, their name, email address, mailing address and date of birth. Entries will be limited to one entry per person per category during the entry period. When entering the contests, entrants will automatically be opted into receive future marketing from Spry Enterprises, LLC via email. Multiple participants are not permitted to share the same email address. Any attempt by you to obtain more than one (1) entry per category by using multiple/different email addresses, identities, registrations or logins, or any other methods may void your entries and you may be disqualified from the promotion. No robotic, programmed, script, macro or other automated entries (collectively “automated entries”). In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holders. All entrants grant Spry Enterprises, LLC and its advertising, promotion and Internet agencies usage rights of entrant’s name and likeness. All entry information submitted becomes the property of Sponsor and will not be returned.

2. ELIGIBILITY: These contests are open only to legal residents of the United States of America who are 18 years of age or older at time of entry. Employees of Spry Enterprises, LLC and/or their affiliates, subsidiaries, advertising, promotion and Internet agencies (“Promotion Parties”) and their immediate family members and/or those living in the same household of each such employee are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by law. Entrants agree that Spry Enterprises, or any of its affiliates/employees, is not responsible for any injuries caused by any negligence of entrant or a third party. Spry Enterprises would respectfully request that all entrants use good judgement during the“BEAUTY”or the “BASH” portion of this competition and avoid any foreseeably dangerous actions or activities.

Contestants must complete the following steps in order to be eligible for prizes:

Register with one of the following methods:
1. At the Beau Cheval Pumpkin Fest
2. Complete online form at www.BeauChevalWartrace.com
Purchase one of the following:
1. Pumpkin(s) from Beau Cheval in Wartrace.
2. Entry of $10 paid online or in person at Beau Cheval in Wartrace
Post entry on your Facebook or Instagram feed and tag @BeauChevalWartrace. Contestant must reference “Golden Pumpkin Contest – Beauty & the Bash” in description, comments or hash tags. Posting entry to social media story will not meet the requirements.

3. PRIVACY: In connection with the Promotion entry process, Sponsor will be collecting personal data about entrants on the Website, in accordance with its privacy policy. Please review Spry Enterprises, LLC’s privacy policy located at http://www.beauchevalwartrace.com/privacy-policy/. By participating in the Promotion, you hereby agree to Sponsor’s & Administrator’s collection and usage of your personal information and acknowledge that you have read and accepted the privacy policy. Except where prohibited, participation in the Promotion constitutes your consent to Spry Enterprises, LLC’s use of your name, likeness, entry, and state of residence for promotional purposes in any media without further payment or consideration.

4. WINNER SELECTION: One (1) Grand Prize winner, One (1) 2nd (Second) Place winner and One (1) 3rd (Third) Place winner and will be chosen from all eligible entries on or about December 19, 2020. Winners will be notified by e-mail, as provided. Two (2) attempts will be made to contact the winners via email within the 48 hours following winner being chosen. From there, the winners will be given 24 hours to respond to the final email notification and accept their prize before they forfeit their prize and a new winner is chosen. Decisions of Spry Enterprises, LLC and their judging partners with respect to the winners and other matters pertaining to the Promotion shall be final. Odds of winning depend on the total number of eligible entries received.

5. CONTEST JUDGING: The Golden Pumpkins Contest – Beauty & the Bash will be judged by a panel of judges independent of Spry Enterprises, LLC. Judging for the Beauty Category will be based on how the entries meet the qualities of 1) Beautification 2) Display 3) Photography. Judging for the Bash Category will be based on how the entries meet the qualities of 1) Wow Factor 2) Safety 3) Videography.

6. PRIZES FOR GOLDEN PUMPKINS CONTEST – BEAUTY CATEGORY:

a) Grand Prize for Golden Pumpkins Contest – Beauty (1 winner)

Cash prize between $50 and $1,000, dependent on number of pumpkins sold. Cash prize will not exceed $1,000. A donation equal to the final cash prize amount will be given to the Nikki Mitchell Foundation in Nashville, Tennessee.

1-999 pumpkin sold = $50 cash prize, $50 donation to charity
1,000-1,999 pumpkins sold = $125 cash prize, $125 donation to charity
2,000-2,999 pumpkins sold = $250 cash prize, $250 donation to charity
3,000-3,999 pumpkins sold - $375 cash prize, $375 donation to charity
4,000-4,999 pumpkins sold - $500 cash prize, $500 donation to charity
5,000-5,999 pumpkins sold - $625 cash prize, $625 donation to charity
6,000-6,999 pumpkins sold = $750 cash prize, $750 donation to charity
7,000-7,999 pumpkins sold = $875 cash prize, $875 donation to charity
8,000 or more pumpkins sold = $1,000 cash prize, $1,000 donation to charity

b) 2nd Place Prize - Beauty (1 winner)

A miniature horse experience at our farm for up to 4 people will be scheduled in coordination with the farm manager. If winner is unable to take the tour at the time designated, winner will forfeit the tour prize.

c) 3rd Place Prize - Beauty (1 winner)

A Beau Cheval in Wartrace Trucker Hat, Tea Towel & Jar of Blackberry Jam made with Beau Cheval in Wartrace blackberries

7. PRIZES FOR GOLDEN PUMPKINS CONTEST – BASH CATEGORY:

a) Grand Prize for Golden Pumpkins Contest – Bash (1 winner)

Cash prize between $50 and $1,000, dependent on number of pumpkins sold. Cash prize will not exceed $1,000. A donation equal to the final cash prize amount will be given to the Good Shepherd Children’s Home in Murfreesboro, Tennessee

1-999 pumpkin sold = $50 cash prize, $50 donation to charity
1,000-1,999 pumpkins sold = $125 cash prize, $125 donation to charity
2,000-2,999 pumpkins sold = $250 cash prize, $250 donation to charity
3,000-3,999 pumpkins sold - $375 cash prize, $375 donation to charity
4,000-4,999 pumpkins sold - $500 cash prize, $500 donation to charity
5,000-5,999 pumpkins sold - $625 cash prize, $625 donation to charity
6,000-6,999 pumpkins sold = $750 cash prize, $750 donation to charity
7,000-7,999 pumpkins sold = $875 cash prize, $875 donation to charity
8,000 or more pumpkins sold = $1,000 cash prize, $1,000 donation to charity

The specifics of all aforementioned elements of the prizes in the Promotion shall be solely determined by Sponsor. Prizes may not be sold and winner must comply with all venue rules and regulations. Failure to do so may result in forfeiture of prize. Prizes are non-transferable. Instructions to claim the prize will be emailed to winner after signed affidavit is received. Prizes are subject to terms and conditions as specified by issuer.

All costs, taxes, fees, and expenses associated with any element of the prizes not specifically addressed above are the sole responsibility of the winner. All federal, state and local taxes on the prizes are the winner’s responsibility.

Total estimated prize value: Due to dependence on pumpkin sales, prize value ranges from $590 to $2,490

8. GENERAL TERMS & CONDITIONS: The Grand Prize winner will be required to complete and return an Affidavit of Eligibility and Release of Liability, Assignment of Rights and, if legally permissible, a Publicity Release within five (5) days of attempted delivery of same. Guest(s) of winner may also be required to sign a Release of Liability and Publicity Release within the time stated above.

Noncompliance within this time period or return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner will be chosen without further notice. No substitution or transfer of any prize by any winner permitted except by Sponsor at its discretion. Spry Enterprises, LLC (Sponsor) reserves the right to substitute any prize (or portion thereof) with one of equal or greater value at its discretion.

All applicable taxes and fees are the sole responsibility of winner. No substitutions, refunds, cash or credit equivalents, redemptions or transfer of prize by winner permitted. Sponsor reserves the right to substitute prize of equal or greater value. In no event will more than the stated number of prizes be awarded. By entering the contests, winner agrees to release, hold harmless and indemnify the Sponsor, the Promotion Parties and their respective employees from and against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorneys’ fees and court costs) arising directly or indirectly from or in connection with his/her participation in the contests, acceptance, possession or use/misuse of the prize or participation in any prize-related activity. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winner's name and/or likeness for purposes of advertising and trade without further compensation, including a winners' list, unless prohibited by law. By participating in this contests, entrants agree to be bound by the Official Rules and the decisions of Sponsor, which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contests materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. All material submitted becomes the sole property of Sponsor and will not be returned. The Sponsor is not responsible for any typographical or other error in the communication of the contests, administration of the contests or in the announcement of the prizes. The Sponsor reserves the right to modify contest rules. The Sponsor the right to cancel the contests at any time, without liability.

9. DISPUTES/GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of any entrant or the Promotion Entities in connection with the Promotion, shall be governed by and construed in accordance with the laws of the State of Tennessee without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of Tennessee. Any action or litigation concerning this Agreement shall take place exclusively in the federal or state courts sitting in Bedford County, Tennessee, and you expressly consent to the jurisdiction of and venue in such courts and waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, shall be resolved individually, without resort to any form of class action. You agree to service of process by mail or other method acceptable under the laws of the State of Tennessee. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. YOU (AND YOUR PARENTS OR LEGAL GUARDIANS IF YOU ARE A MINOR) HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY'S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.

10. WINNERS ANNOUNCEMENT: Winner will be contacted via email by December 19, 2020. Winner may also be announced via Sponsor’s social media channels within the month of December 2019. For the name of the winner, available after February 15, 2020 send a self-addressed stamped envelope to: Golden Pumpkins Contests c/o Spry Enterprises, LLC 6999 Highway 64 East, Wartrace, Tennessee 37183. Requests must be received by June 1, 2021.
